Recording Studio

Booking

  1. The client may extend a project providing availability with both the studio & engineer. Any additional fee will be included on the final invoice.
  2. Any additional equipment or outsourced services required for the project will be at the expense of the client and must be paid for in full. These additional fees are non-refundable unless agreed.
  3. Bookings will be confirmed on payment of 25% of the quoted fee and represents acceptance of this Agreement.
  4. Booking amendments may be made up to 2 weeks before the booking date, subject to availability.
  5. Deposits are non-refundable if a project is cancelled within 2 weeks of the booking date.
  6. Upon project completion, an invoice will be sent to the client explaining final costs due and payment terms

 

Project Delivery

  1. Unless otherwise requested, Monastery will provide the services at its premises.
  2. Revisions may be requested within 1 week of project delivery and will be completed free of charge.
  3. If after 1 week no revisions have been requested or if confirmed by the client as complete, then the project will be deemed complete, and any further changes will be charged at the standard hourly rate.
  4. The client will be provided with a link to download the completed recordings prior to project completion and full payment.
  5. A copy of the full session data will be provided to the client on completion of the project and the full session data will be archived for 6 months by Monastery, however will not be responsible for maintaining the data and data recovery may not be possible.

 

Fees & Working Hours 

  1. A full studio day consists of 8 hours from 10am-6pm.
  2. Working hours can be altered on request and may incur additional fees.
  3. Quotes and booking of additional equipment or outsourced services required for the project can be obtained by Monastery on behalf of the client and any charges will be the responsibility of the client and will be passed directly to them.
  4. Payment for the services must be received within the agreed payment terms and no final recordings or session data will be released, nor will the ownership of the recordings be transferred to the client until final payment has been received.
  5. Balances which are not paid within the agreed payment terms will be subject to the Late Payment of Commercial Debts (Interest) Act 1998 and interest will be added to any outstanding balance at the statutory interest rate of the Bank of England base rate plus 5%.

 

Copyright

  1. The client indemnifies Monastery against any claim which may arise due to the exploitation of works recorded at Monastery where relevant permissions have not been obtained by the client prior to exploitation.
  2. The Client may opt for Monastery to act as producer for the Project at no extra cost.  If the Client does choose Monastery to act as producer then Monastery exercises its right to receive the following credit on all labels, sleeves of all configurations of product and any paid trade advertising: “Recorded and Produced at Monastery Recording Co.”.

 

Limitation of Liability

  1. Nothing in this Agreement excludes any liability which Monastery may not lawfully exclude under contract, including but not limited to personal injury or death caused by Monastery’s negligence.
  2. The Client agrees that Monastery will have no liability and will not be obligated to make any refund and shall otherwise not be responsible in the event of any: Delay, cancellation, or strike, riots, floods, acts of god, security breach, technological failure, health scares, or any other cause beyond our control, and further that Monastery shall not have any responsibility for any additional expense resulting from any such acts or events or from any acts of any government or authority.
  3. In no event shall Monastery be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, the use of the Studio, whether based on contract, strict liability, or otherwise, even if Monastery have been advised of the possibility of damages, except where Monastery may not lawfully exclude such liability under contract.
  4. Monastery accepts no responsibility for loss of or damage to any articles (including personal belongings) brought on to the premises by the client or their associates.

 

Damage & Theft

  1. The Client is responsible for all equipment and every person who is booked on their behalf.  If, at any time during or directly after your time at the studio, damage or theft of Monastery’s property is discovered, the client will be charged for the replacement or repair.
  2. The Client will be expected to leave the studio in the condition in which it was found and ensure that personal belongings and any litter are removed at the end of the studio session.
  3. There is a strict no smoking policy at the studio. Monastery reserve the right to remove any person who is caught in violating this policy.
  4. The Client shall not use the studio in any way which may result in annoyance or disturbance to the other occupiers or users of the premises surrounding the studio.  Monastery reserve the right to remove any person whose behaviour is considered inappropriate in the studio. No refund will be payable if a person is removed.
  5. The client will be responsible for keeping proper order during their time in the studio and for ensuring that all companies conduct themselves in an appropriate manner and comply with all rules of the studio. The studio manager reserves the right to refuse to admission, or instruct removal of any person who, in the studio manager’s opinion, is not in a fit and proper demeanour to be on the premises, this includes but is not limited to a state of sobriety.
  6. CCTV is in operation at all times on site.
  7. The Studio cannot be held responsible for any damage or loss to any vehicles or personal belongings left on site, including items left on site over night.

 

Rehearsals

  1. Dates & times are subject to availability and approval from Monastery, who also reserve the right to refuse and reschedule. Monastery reserves the right to cancel bookings at any time with or without prior notice or explanations. The band / Artist will not be charged for any cancellation made by Monastery.
  2. It is the responsibility of the person booking the session to pay for the hours booked.  In the result of a late cancellation/no show, a payment link will be sent to whomever made the booking. 
  3. We have a 48 hour cancellation policy on all rehearsal bookings.  If a cancellation is made with less than 48 hours notice, the person who booked it will be sent a payment link for the session.  That person and their band will not be able to book future sessions until the payment is made. 
  4. It is advised to arrive close to your session start time, as staff may not yet be on site, or another band may be using the room.  If you do arrive early, please wait in the carpark until a member of the team has come down to open the door.
  5. You must be loaded out of the room by the end of your session time. Please allow enough time to break down and load out. 
  6. If you wish to extend your session during your rehearsal, please ask and we will try our best to accommodate this.
  7. Please make sure both doors to the practice room are firmly closed before making any noise.
  8. Any damage caused to equipment due to misuse and abuse will be charged to the band/individual. Refusal to pay for breakages will lead to exclusion and prosecution. If an item of equipment is damaged or missing at the start of your session please report it immediately.  If you are unsure how to operate any equipment, we will be happy to assist you.
  9. Please make sure that you do not leave personal items unattended and ensure that you take all your belongings with you when you leave. Monastery is not responsible for any items that are lost or damaged on the premises.
  10. Food and drink are permitted in the rooms, but please do not place them on equipment and report any spillages immediately.  We kindly request that the rooms are left in the same state as at the beginning of your session.  
  11. Monastery will not be held responsible for any injury incurred onsite.
